1. Agreement to Terms

By accessing or placing an order on Devines ("the Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, please discontinue using the site. We reserve the right to modify these Terms at any time, and continued use signifies acceptance of updated terms.

2. Platform Role & Marketplace Structure

Devines is a curated luxury marketplace connecting independent collectors and sellers with global fashion buyers.

  • Independent Sellers: Sellers remain responsible for accurate listing information, clear title, and item condition.

  • Devines Operations: Devines acts as the merchant of record for payment collection, manages physical quality checks (QC) and authentication, facilitates dispute resolutions, and handles international shipping.

  • Brand Affiliation: Unless explicitly stated, Devines is an independent reseller and is not affiliated, sponsored, or endorsed by any luxury brands listed on our platform.

3. Account Guidelines

  • You must be at least 18 years old to create an account or make purchases.

  • You are responsible for maintaining account credential confidentiality and all activities performed under your profile.

  • Users are restricted to one active account.

4. Buying, Pricing, & Orders

  • Order Formation: Submitting an offer or checkout request initiates an order. An order is formally accepted once payment processing is completed and Devines sends an order confirmation.

  • Pricing & Fees: All listed item prices are in USD. Standard service and payment handling fees are displayed clearly before payment authorization.

  • Fulfillment & Cancellation: Orders are subject to item availability and physical authentication. If an item fails inspection or becomes unavailable, Devines will cancel the order and issue a 100% complete refund.

5. Seller Responsibilities & Payouts

  • Sellers grant Devines a global license to display, host, and market listing photos, descriptions, and media across our web channels and promotional feeds.

  • Sellers must disclose all item conditions accurately.

  • Payouts are released to sellers only after an item successfully passes physical inspection at our verification facility.

  • Off-platform transactions arranged outside of Devines are strictly prohibited and will result in immediate profile bans.

6. Physical Inspection & Authentication

Every item undergoes in-hand condition checks and authentication prior to final dispatch. While Devines utilizes professional standards to inspect items, our verification report reflects the item’s state at the time of warehouse evaluation. Devines is not responsible for post-delivery wear or handling damage.

7. Payments & Currency

  • Payments are processed via secure third-party payment gateways (including Stripe and PayPal).

  • Devines does not store credit card numbers on its servers.

  • Transactions are conducted in USD. Refunds are issued in USD back to the original payment method.

8. Shipping & Delivery

  • Tracking & Delivery: Tracking numbers are issued as soon as items leave our warehouse. Delivery times are estimated, and Devines is not liable for carrier-based transit delays.

  • Duties & Taxes: Import tariffs, VAT, or local customs fees are the sole responsibility of the buyer.

  • Lost or Damaged Parcels: Confirmed losses by shipping carriers are fully refunded. For items valued over $750 USD, signature confirmation upon delivery is required.

9. Returns, Refunds, & Buyer Protection

  • All sales are final once an item passes quality control and delivers as described.

  • Full refunds are issued if an item fails authentication, is unavailable, or arrives materially different from listing photos and notes.

10. Prohibited Conduct

Users agree not to:

  • Attempt to sell counterfeit or stolen merchandise.

  • Circumvent our platform payment processing.

  • Misrepresent item condition or supply fraudulent payment information.

  • Engage in unauthorized web scraping, automated bots, or system interference.

Violations will lead to account termination and legal remedies where applicable.

11. Intellectual Property Rights

All original website design, logos, graphics, and underlying code are owned by Devines. Brand names, designer logos, and trademarks shown on the site belong to their respective owners and are used purely for product identification purposes.

12. Limitation of Liability & Indemnification

  • To the maximum extent allowed by law, Devines provides its platform on an "as-is" basis. Our maximum financial liability for any service claim is limited to the fees collected for the specific transaction in question or $100 USD.

  • Users agree to hold Devines and its officers harmless from third-party claims, losses, or legal costs arising from account misuse, listing policy breaches, or intellectual property infringements.

13. Governing Law & Dispute Resolution

These Terms are governed by general marketplace commercial principles. In the event of a dispute, buyers agree to attempt informal resolution by contacting customer care first before initiating legal proceedings or third-party claims.
